1. This promotion is offered by On the Beach Limited, whose registered office is 5 Adair Street, Manchester, M1 2NQ ("OTB"). By participating in the promotion, you shall be deemed to have accepted these terms and conditions.
2. If you make a Qualifying Booking (defined below), each booking will, subject to availability, receive one complimentary £75 M&S Gift Card (“Gift Card”):
Gift cards and e-gift cards can be redeemed at M&S stores in the United Kingdom, ROI and the Channel Islands (including outlet, railway, motorway and airport stores, but excluding Jersey, BP Connect and Applegreen petrol filling stations and M&S Opticians locations). They can also be redeemed online at marksandspencer.com.
M&S e-Gift Cards will be delivered activated and can be spent immediately.
Gift Cards and e-gift cards may be used to purchase goods of a higher price than the amount on the card, on payment of the difference.
Gift cards cannot be exchanged for cash or used to pay for M&S Bank services, products, or outstanding card balances, made to measure shirts, personalised cards, to buy another gift card, e-gift card, or to pay Clearpay instalments.
Gift cards cannot be used on Ocado.com
Gift card balances can be viewed on the M&S website under ‘check balance’ in My Account. You can also check your balance by telephone on 03330 148 443 in the UK and Channel Islands. Local rates apply but please note mobile rates vary. Your balance can also be checked in store by presenting your barcode for scanning at the till.
Gift cards and e-gift cards are valid for 48 months from the last transaction (which includes the initial card load, adding or spending funds, or balance enquiries).
Any remaining balance will be cancelled on expiry of the validity period.
3. Qualifying Booking means a booking which meets all the following requirements:
Order must be for a package holiday that includes flights and any accommodation (for any board basis and star rating) to Turkey, departing anytime;
Order must be placed between 00:00 and 23:59 (inclusive) on either Saturday 14th December or Sunday 15th December 2024;
4. You will receive one M&S £75 Gift Card as described at paragraph 2 above per Qualifying Booking. Details of how to redeem the Gift Card will be sent to the lead passenger via email to the email address used when making the Qualifying Booking.
5. Availability: This promotion is subject to availability as there is a set allocation of 200 Gift Cards. OTB expects to be able to run the promotion for the whole of weekend of 14th and 15th December 2024 but it may be withdrawn before 23:59 on 15th December 2024. Maximum 1 Gift Card per Qualifying Booking.
6. The Gift Card is digital and it is non-exchangeable and no cash equivalent will be given by OTB in any circumstance including if you are unable to access or use because you don’t have a compatible device.
7. You should receive the Gift Card within 24 hours of receiving your booking confirmation but may take up to 5 days if we need to contact you before your Qualifying Booking is confirmed. If you’ve not received your voucher within 5 days of receiving your booking confirmation, please get in touch at marketing@onthebeach.co.uk with your name, email address and MYB number (shown on your booking confirmation).
Legal
8. Subject to paragraph 8, OTB shall not be liable for any loss you suffer howsoever arising from the provision (or non-provision) or use of the GC.
9. Nothing in these terms shall exclude or limit the liability of OTB (i) in relation to personal injury or death caused by OTB’s negligence or (ii) in respect of its obligations under applicable legislation.
10. The personal data you provide will be processed in accordance with OTB’s privacy policy OTB will use the personal information provided by you for the purposes of administering the promotion.
11. OTB’s standard booking conditions apply to bookings, please refer to our terms of business and the other terms and conditions displayed as part of the booking journey.
12. These terms and conditions (and any issues or disputes arising) shall be governed by the law of England and Wales law, and the parties submit to the exclusive jurisdiction of the English courts.
